Italian Data Protection Agency Extends Olive Branch to OpenAI, Allowing Them to Evade Ban

Italian Data Protection Authority blocks OpenAI’s ChatGPT in Italy
In late March, the Italian Data Protection Authority (the “Garante”) made a significant announcement regarding OpenAI’s ChatGPT software. Due to concerns about potential violations of the GDPR, the Garante decided to block the use of this software within Italy. This decision was based on the need for OpenAI to address specific requirements to ensure compliance with data protection regulations.
Steps to Lift the Restriction
The Garante outlined a series of steps that OpenAI must take by the end of April in order to lift the restriction. These steps include providing detailed information on data processing practices and user rights. Furthermore, Italian users will be required to confirm that they are over 18 years old before registering for the service. By September, the platform must also implement an age-gating system to restrict access to minors.
Compliance Deadline and Penalties
OpenAI has been given a deadline of 18 days to comply with the outlined requirements. Failure to meet these obligations may result in additional penalties for the company. Additionally, OpenAI must provide tools for individuals who are not users of the platform to object to data processing. An advertising campaign must also be launched by May 31st to inform users about data collection methods and algorithm training processes.
